1. Definitions

“Business Days” means days of the week from Monday to Friday (except for statutory holidays).
“Delivery Time” means the number of days it takes to ship the goods after production is complete.
“Order”, “Order Acceptance” means a declaration of Customer’s intent to purchase, which directly results in payment of the Order, or issuance of an invoice to the Customer with the details of the Order; Orders may be placed by electronic means through the Website or through email.
“Person” means any person, firm or company.
“Privacy Policy” means the document governing security of protecting and processing Clients’ personal data.
“Product” means the product which the Seller is to sell in accordance with these Terms of Service.
“Sales Agreement” means a Products sales agreement, thus the Order and acceptance of the Order by candorpackaging.com; Sales Agreement is concluded between the Seller and the Customer by means of the Website’s sale system in accordance with the provisions of these Terms of Service.
“Seller” means candorpackaging.com
“Service” means all of our web-based applications, tools and platforms that you have registered to use or that we otherwise make available to you, and are developed, operated, and maintained by us, accessible via https://candorpackaging.com/ or another designated URL.
“Terms of Service” means the standard terms and conditions of rendering and using of the services in the Website set out in this document.
“You”, “your” or “Customer” means the person or entity using the Service and identified in the applicable account record, invoice, or order record as the customer.

AGREEMENT TO THE TERMS OF SERVICE

2. Legal notice

By visiting candorpackaging.com and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”), These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products or services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws, rules or regulations in your jurisdiction (including but not limited to copyright laws).
A breach or violation of any of the Terms will result in an immediate termination of your use.

3. Products & Services

All Products are made to order based on your custom specifications. You, the Customer, are responsible for ensuring that your order correctly specifies size, color, artwork, quantity, style of product, and type of product. Candorpackaging.com is not responsible for errors made by the Customer during the ordering process.
We cannot guarantee that your computer monitor’s display of any color, artwork, sizing, or feature will be accurate.

4.Customer submitted art work

All artwork or designs and images must be provided in CMYK format and with a minimum resolution of 300 DPI. Candorpackaging.com is not responsible for any color changes that occur in conversions from RGB to CMYK color modes. packagingbee.com™ is also not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.

5. Payments Quotation and delivery

Payments for Orders must be made in full prior to the start of production
All quotations for packaging, products, and services are valid for 14 days. Upon order confirmation, payment must be made in full within 3 days. After 3 days Candorpackaging.com reserves the right to provide a new quotation for the entire order.
We endeavor to process every production order within 5 (five) Business Days. The Order processing time shall not include the delivery time. Candorpackaging.com normally offers 8 to 10 business days for shipping but all the delivery dates stated are only approximate. We shall not be liable for any losses or expenses incurred due to the delay in delivery of the Products. Candorpackaging.com try its best to deliver products on time.

6. Proofing and Matching

All custom production and printing jobs require customer approval of the final art work and job specification sheet. Once an order has been placed, final artwork proofs and a job specification sheet will be sent to customers via email. Customers are in charge of reviewing all the details mentioned in the specification sheet, including but not limited to, delivery dates and or production speed, and confirm that all of the customer requirements have been accurately noted. Candorpackaging.com is not liable for any specifications and requirements beyond what are noted in the final specification sheet. In addition, it is the responsibility of the customer to review the final artwork proof as proofreading is the responsibility of the customer. Due to the multiple ways that files are prepared, unplanned changes can occur. What is shown on the final proof represents what will be printed. Candorpackaging.com strongly recommends that the proof be printed out at 100% to check actual position, spelling, and other design elements. Candorpackaging.com will not be responsible for any design or spelling issues that are not identified by the customer and communicated to us immediately. Upon approval, the design file and job specifications will be forwarded to the production department and printed as it is.

7. Color accuracy

Candorpackaging.com is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs predict design layout, text accuracy, image proportion and placement, but not color or density. we will do our best to match the gradient density of each color in duo-tone. Candorpackaging.com is not liable for the final appearance of a duo-tone unless the customer orders a color match proof. In addition, application of lamination may affect or change the appearance of the printed colors. Candorpackaging.com is not liable for the final color appearance of a laminated products. Notably, Candorpackaging.com use the international screen-based color system of RGB and the print color system.

8. Materials used in production

Please bear in mind that the paper/card stock used for production is not food grade. If you’ve any specific food grade requirement with regards to paper stock, please let us know before placing this order. Any such requirement should be communicated in writing immediately to candorpackaging.com (info@candorpackaging.com).

9. Customers are bound for final approval of proof and layout prior to production

Otherwise candorpackaging.com is NOT LIABLE for errors in Final product caused by any of the following:

  1. Graphics Orientation or Placement and Incorrect Font Usage.
  2. Spelling, Grammatical and Punctuation Errors.
  3. Wrong Die cuts, slits or Incorrect and Missing Folds.
  4. Finished Product Size.

Candorpackaging.com will reprint your original order if candorpackaging.com made an error or find it defective. Determination of defect is at the discretion of our management. To receive the reprint of your original order, you must submit digital photos documenting the product defect or return, at your own expense, the full quantity of the original order to us within 7 business days of taking the original order delivery. Charges related to the expedited orders processing are non-refundable.

10. Samples

Samples may be made by hands only to check the quality of product. Samples and prototypes are not to be considered final products, and the Buyer acknowledges that unfinished products do not always meet the full quality assurance standards of final deliveries. For samples, we use digital printing.
The main purpose of sample is to check the following:

  1. Paper stock used to produce product
  2. Graphics Orientation or Placement
  3. Finished Product Size.

11. Overruns/Underruns

Candorpackaging.com will normally deliver the exact quantity of goods ordered plus a small additional amount. There is no extra charge for the additional quantity. In the event of an underrun, we will bill for the actual quantity delivered. We follow the generally accepted trade practice of delivering plus or minus 5% of the ordered quantity.

12. Order cancelation

Candorpackaging.com will cancel your order prior to production. However, if you’re ordered item has been produced or shipped then it cannot be cancelled. Orders may be cancelable during the various production stages but cancellation charges will apply. Our Customer Service Team will inform you of any cancellation charges.

  1. Placement of Order to our sales department.
  2. Sent details and source files of client to our graphic department to prepare design.
  3. Sent relevant information to our production department to arrange raw material to produce such products.
  4. After above steps, sent final art work and job specification sheet to customer for final approval
  5. After obtaining final approval order sent to production department (it includes printing, cutting, pasting and finishing)
  6. Final products are sent to shipping department for shipment.

All orders are cancelable before stage 3. If an order is cancelled in stage 1,2; you will not be charged. For orders cancelled before stage 4, minimum10% of the total order amount is deducted
After an order enters stage4, we can still try to cancel the order but we cannot guarantee order cancellation. However, if the order is still in stage4, and the user wants to have it cancelled; a minimum of 20% of the total order amount is deducted to cover expenses. Once an order reaches stage 5, it cannot be cancelled. (Charges does not include transaction cost charged by PayPal or any other payment gateway.) 

13. Return and Refund policy

As all orders are customized All Sales Are Final. If we verify that we made an error, we will reproduce the order. No Refunds or Credits. Determination of defect is at the discretion of our management.
The customer must notify Candorpackaging.com within 3 business days of order delivery of any defects, damage, or missing items discovered in the delivered products. Candorpackaging.com will not be responsible for any claims for defects, damage, or missing items that are not filed within 3 business days of the delivery date.

14. Indemnity

You agree that you shall indemnify and defend Candorpackaging.com and all parties from whom Candorpackaging.com has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms and Conditions or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Site Content.

15. Disclaimer of warranties

CANDORPACKAGING.COM DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF OUR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
CANDORPACKAGING.COM DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notify to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. THE SERVICE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ALL STATUTORY WARRANTIES AND IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

16. Limitation of liability

Under no circumstances candorpackaging.com including its members, directors, employees, representatives, vendors, suppliers, affiliates and subcontractors will be liable for any injury, death, loss, claim, damage, act of God, accident, delay, or any special, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with any use of our website or with any delay or inability to use our website, or for any information, software, data, products or services obtained through our website, even if a party has been advised of the possibility of such damages.
In no event shall our total liability to you for all damages, losses and causes of action including but not limited to negligence, arising from this agreement or your use of our website exceed the amount paid by you to candorpackaging.com for the order or request.

17. Design files given by Candorpackaging.com

Candorpackaging.com will only provide design files at 72 DPI (low resolution). If you would like to purchase higher resolution designed files, please contact info@candorpackaging.com for a quote.
